JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2015 Heard the learned counsel for the petitioners as well as the learned for the State.
The petitioners being father-in-law and brother-in-law of the victim are languishing in custody since 07.12.2014 and 09.02.2015 respectively in a case registered for the offences punishable under sections 328 and 302/34 of the I.P.C. The prosecution case is that son of the informant, namely, Mundrika Manjhi was married with the daughter of petitioner no.1 three years prior to the occurrence and he was done to death by the members of in-laws family.
It is submitted by learned counsel for the petitioners that only on suspicion allegation has been levelled against the
Patna High Court Cr.Misc. No.26208 of 2015 (2) dt.27-07-2015 2/2 petitioners and further on conclusion of the investigation final form has been submitted under section 306/34 of the I.P.C. as the wife of the victim has stated that the victim died due to snake bite. Considering that final form has been submitted under section 306/34 I.P.C, the above named petitioners are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M. Danapur, Patna in Akilpur P.S. Case No. 35 of 2010.
