JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2019 Petitioner apprehends his arrest in connection with Complaint Case No. 537(C) of 2016 in which cognizance has been taken for the offence punishable under Sections 498A of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

Petitioner is husband and the case is of subjecting his wife to cruelty and harassment due to demand of Rs.5 lakh. Submission of learned counsel for the petitioner is that she did not marry with him and due to pressure her marriage was solemnized with him and she does not want to live with him but petitioner is ready to keep his wife with him. Heard learned APP also.

No.4469 of 2019(2) dt.29-01-2019 2/2 Having heard both sides and in the facts and circumstances, this application is disposed of with direction to petitioner to surrender within a period of six weeks from the receipt of this order and on surrender he will be released on provisional bail for a period of three months to the satisfaction of the court below itself and in the meantime learned court below will issue notice to the wife of the petitioner and on her appearance the court below will try to re-conciliate among them and if it is found during re-conciliation that petitioner is ready to keep her, learned court below shall confirm his bail bond, otherwise learned court below is free to pass any other order(s) as it may deem fit and proper.

With the above observation, this application is disposed of.
