Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Originally, informant filed complaint Case on 27.05.2013 which was converted into Balrampur P.S.Case No. 64 of 2013 and the accusation against this petitioner is that he induced the informant's minor daughter and took her away from her custody.

The contention on behalf of the petitioner is that in Para-3 of the complaint petition, it has been admitted by the informant that her house stood in the land of the petitioner and it is a matter of fact, that family members of the petitioner asked the

No.26174 of 2014 (4) dt.09-01-2015 informant to vacate the land, thereafter the informant lodged this false case and prior to filing of the present case, the daughter -inlaw of the informant had lodged Balrampur P.S.Case No.50 of 2014 against the petitioner and his other family members. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Balrampur P.S.Case No.64 of 2013.
