JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 26.09.2014 in a case registered for the offences punishable under Sections 307 and 387/34 of the Indian Penal Code, Section 27 of the Arms Act and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act. It is alleged that two miscreants came on motorcycle and resorted to fire. Though, first shot did not cause any injury but due to second shot, the informant received injury on his leg. It is also alleged that extortion demand of Rs. 50 lakhs were made from the owner of paltry form namely Pankaj Kumar, though, the FIR was lodged against unknown. Name of the petitioner sprang up on the confession of co-accused.

It is submitted by learned counsel for the petitioner that the petitioner has not been put on TI parade, statement to that

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge, Sitamarhi in connection with Tr. No. 47 of 2015 arising out of Sitamarhi P.S. Case No. 544 of 2014.

Since the petitioner has criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions or gets involved in some serious nature of offence.
