2. The petitioner is in custody in connection with K.Hat (Sahayak) P.S. Case No. 1023 of 2023 registered for an offence punishable under Sections 302 and 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Allegation against all the accused persons is to have committed murder of the son of the informant along with other co-accused persons.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that there is no eye witness to the alleged occurrence and similarly situated co-accused persons have already been

Nos. 10945 of 2024 as well as similarly situated coaccused persons have already been granted bail by this Court passed in Cr. Misc. Nos. 4542 of 2024 and 16328 of 2024. Petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 01.09.2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. Considering the aforesaid facts as well as the fact that similarly situated has already been granted bail by this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with K.Hat (Sahayak) P.S. Case No. 1023 of 2023.
