2. The petitioner is in custody in connection with IIT Amhara P.S Case No. 39 of 2024 registered for the offences punishable under Sections 69 of the BNS.
3. As per prosecution case, the informant is employed in Bihta IIT as junior assistant and during his work she came into touch with the petitioner who was doing his P.H.D. in IIT Bihta and on 10-05-2022, the petitioner forcibly made sexual relation with the informant and continued the same. Thereafter, on the basis of false promise to marry with the informant and asked the
Patna High Court CR. MISC. No.7056 of 2025(3) dt.19-04-2025 2/3 informant to take divorce from her husband and when her husband became ready for the same, he refused to marry with the informant. On the basis of the written report of the informant, the F.I.R. was lodged under Sections 69 of the B.N.S.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further stated that in the instant case the informant is married lady and the petitioner is student of IIT, Patna and while pursuing the P.hd in Mathematics they were developed friendly relationship and as far as the question is pertaining to the promise of marriage it is submitted that the petitioner never promised for the marriage with informant as the informant is already married and the same could be perused from the F.I.R. It is further submitted that petitioner has got no criminal antecedent. It is also submitted that petitioner is in judicial custody since 04.12.2024.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR and impugned order it appears that, informant is already married and she resides

7. Considering the aforesaid facts and circumstances of the case, materials on record and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.MI, Danapur/Concerned Court in connection with IIT Amhara P.S Case No. 39 of 2024.
