The petitioner is languishing in custody for the offence punishable under Sections 353, 384, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is of giving threat to a Judge of the District Court on mobile phone. Submission is that the referred mobile is not of the petitioner rather of one Laxmi Taneja. On the same day, the call was made to three different persons by the same mobile and three separate cases were registered and in these cases petitioner has been implicated. Besides these cases, there is no other antecedent against the petitioner. Petitioner is in custody since 02.06.2020. Investigation of the case is already complete. Considering the entire facts of this case, especially the

No.16115 of 2021(3) dt.04-10-2021 2/2 fact that the mobile from which threat was made was not of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Samastipur Town P.S. Case No. 73 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
