It appears that the present appeal has been filed by the plaintiff against the order dated 30.06.1987 passed by the SubJudge-III, Bhagalpur in T.S. No. 417 of 1986. The respondent nos. 1 and 2 are wife and son of the appellant who executed the sale deed in favour of the respondent nos. 3 and 4 by virtue of registered sale deed dated 24th November 1986 and 25th November 1986. None of the defendants appeared in the court and the suit was dismissed exparte. The present appeal against the respondent 4 has been dismissed on account of non-compliance of order dated 02.03.2016. The respondent nos. 1 and 2 are family members of the appellant related as wife and son.

In spite of repeated call, nobody appeared for the appellant. It appears that the appellant has ceased to have any

Patna High Court FA No.411 of 1987 (10) dt.14-03-2018 2/2 interest in prosecuting this appeal.

In the aforesaid facts and circumstances, this appeal is dismissed.
