Mr. Tapeshwar Sharma, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 04-02-2025 Heard learned counsel for the petitioner as well as learned APP for the State.

2. The learned counsel appearing on behalf of the petitioner submits that petitioner was granted the privilege of anticipatory bail by an order dated 08.01.2025 in Cr. Misc. No.88133 of 2024 with a condition that one of the bailor of the petitioner shall be his father, Rakesh Dubey. It is submitted that father of the petitioner died on 15.06.1995 as would manifest from Annexure-P/2 to the modification application. It is submitted that Cr. Misc. No.88133 of 2024 was affidavited by Jyoti Kumari , the wife of the petitioner, but inadvertently she could not disclosed the said fact as such the said inadvertence was caused while describing the petitioner in Cr. Misc.

Patna High Court CR. MISC. No.4701 of 2025(2) dt.04-02-2025 2/2 No.88133 of 2024 i.e. petitioner was described as son of Rakesh Dueby when he ought to have been described as son of Late Rakesh Dubey.

3. The learned APP also in view of Annexure-P/2 to the modification application does not dispute the said submission of the learned counsel appearing on behalf of the petitioner.

4. In view of the submissions made by the learned counsel for the petitioner, the order dated 08.01.2025 in Cr. Misc. No.88133 of 2024 is modified to the extent that if petitioner surrenders within the time stipulated in the order dated 08.01.2025 in Cr. Misc. No.88133 of 2024, in that event his bail bond shall be accepted on the condition that one of the bailor of the petitioner shall be his wife, Jyoti Kumari who has sworn the present affidavit.
