In this case the petitioner seeks bail in Mushahri P.S.Case No. 209/2015 instituted for the offences under section 364A of the Indian Penal Code.

As per allegation made by the informant, Mantu Das had kidnapped the son of the informant. From the statement under section 164 Cr.P.C. it appears that Mantu Das took the victim in Diyara area for the purpose of kidnapping and demanded the ransom amount. Later on some others fled away from the clutches of Mantu Das and his associates and the villager has handed over the boy to the police. The informant as well as the victim has identified the petitioner in the Test Identification Parade. The petitioner is in jail since 1.1.2016.

Patna High Court Cr.Misc. No.17197 of 2016 (2) dt.26-04-2016 Looking to the nature of allegation, this court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail is rejected.

The court below is directed to expedite the trial. If the trial is not concluded within one year, the petitioner may renew his prayer for bail.
