Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Warisnagar P.S. Case No.354 of 2022 dated 16.11.2022 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment)Act, 2022. 3.

The main submissions advanced by the learned counsel for the petitioner are that the instant matter relates to recovery of 3.750 litres of english wine and the same was recovered from a Madai (hut) situated at Ram Nagar Dam and against the petitioner there is criminal antecedent of one case in which he is on bail and he has been languishing in jail since 16.11.2022 and against him the investigation has been completed.

Learned APP appearing for the State has opposed the bail prayer.

Considering the above submissions and mainly the petitioner's custody period and quantity of the seized wine, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Warisnagar P.S. Case No.354 of 2022.
