The petitioner is apprehending his arrest in connection with Jhajha P.S.Case No.421 of 2017 dated 28.12.2017 registered for offences punishable under Sections 423, 307, 34 of the Indian Penal Code and thereafter Section 302 of the IPC. Allegation as per FIR is that the petitioner and accused persons had taken the son of the informant and later of he found his son in injured condition and saw the accused persons including the petitioner fleeing away from there. Submission of the learned counsel for the petitioner is that there is delay of one month in lodging the FIR and except suspicion there is nothing against him.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court CR. MISC. No.2140 of 2019(3) dt.13-03-2019 2/2 circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court and if possible to be disposed of on the same day.
With the aforesaid observation, this application is disposed of.
