The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., on search being conducted 378 litres of IMFL was recovered and accused persons were taken into custody. On the statement of accused persons made before the police the name of the petitioner transpired.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the person or possession of the petitioner who is in custody since

Patna High Court CR. MISC. No.15869 of 2021(2) dt.06-08-2021 2/2 11.11.2020 and investigation in the case has concluded. He has been implicated in the case because of his antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and in view of the allegations in the F.I.R. together with the petitioner having remained in custody for more than 8 months, the Court directs the petitioner to be enlarged on bail in connection with Town P.S. Case no.575 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
