JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-07-2015 Petitioner is languishing in custody since 14.04.2015 in a case registered for the offences punishable under Sections 406, 420, 120B, 467, 468, 471, 363, 364, 34 of the Indian Penal Code.
It is alleged that petitioner and co-accused Gyasuddin Ansari persuaded the informant to get his sons Shahid Hussain and Mojahid Hussain employed abroad and demanded Rs. 2,50,000/-. Ultimately the informant paid Rs. 60,000/- to co-accused Gyasuddin Ansari who after collecting the same handed over to the petitioner then thereafter accused persons asked the informant to deposit rest amount in the accounts of Asraf Ansari and Tausif and consequently on different dates the balance amount were deposited. It is submitted by learned counsel for the petitioner that admittedly the money was neither given to the petitioner nor it was deposited in his account. It is further
Patna High Court Cr.Misc. No.25776 of 2015 (2) dt.24-07-2015 2/2 submitted that co-accused Gyasuddin Ansari and others have been granted bail vide Cr. Misc. No. 25139 of 2015. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, East Champaran at Motihari in connection with Palanwa P.S. Case No. 55 of 2014.
