JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Buxar (Town) P.S. Case No. 420 of 2018 dated 08.08..2018 instituted for the offences under Sections 366(a), 120(b) of the Indian Penal Code. The sixteen years old daughter of the informant went missing. It was reliably learnt by the informant that the son of the petitioner and others had abducted the daughter of the informant. It appears that the daughter of the informant had some kind of liaison with the son of the petitioner.

After the victim girl was recovered, she made her statement under Section 164 Cr.P.C stating that she had

So far as the petitioner is concerned, it has only been alleged against him that he asked the daughter of the informant to stay in his house for two days, whereafter she was made to go by train to her home. The learned counsel for the petitioner has submitted that in the 164 Cr.P.C. statement, the victim has not stated anything negative about the petitioner. It further appears from the entire sequence of the events that the daughter of the informant had some association with the son of the petitioner and the only fault of the petitioner is that he permitted the daughter of the informant (victim girl) to stay in his house for two days, away from the custody of her parents.

Considering the aforestated aspects of the case and taking into account that the victim girl has stated nothing against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.4854 of 2019(2) dt.29-01-2019 3/3 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar(Town) P.S. Case No. 420 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
