The petitioners are apprehending their arrest in connection with Rahika P.S.Case no.157 of 2017 , registered for offences punishable under Sections 147, 149, 341, 342, 353 of the Indian Penal Code.
Allegation against the petitioners as per FIR is that the police in order to arrest the accused person went to his house but the petitioners and several other accused persons tried to obstruct the police party in discharge of their public duty and also damaged the police van.
Submission of the learned counsel for the petitioners is
Patna High Court Cr.Misc. No.2720 of 2019(4) dt.21-02-2019 2/2 that they have been named in the FIR and nothing specific has been attributed against them as well as they have no criminal antecedent.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Madhubani in connection with Rahika P.S.case No.157 of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
