The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No.89 of 2015 for the offence punishable under Section 395 of the Indian Penal Code.
The prosecution story, in brief, is that while the informant was returning to Araria, one Victa vehicle stopped him on N.H.77 and thereafter seven persons came out from the said vehicle and snatched key of his Scorpio vehicle and fled away with his vehicle. The miscreants also snatched his mobile and ATM card. It has been submitted on behalf of the petitioner that the petitioner is not named in the first information report nor there is any recovery of the incriminating articles from his possession. It has further been submitted that the petitioner has not been put on
Patna High Court Cr.Misc. No.25735 of 2015 (2) dt.11-06-2015 2/2 test identification parade in the present case. Further it has been submitted that the petitioner has got no criminal antecedent and he is in custody since 13.03.2015.
On behalf of the State, it has been submitted that the petitioner's name has figured on the basis of the confessional statement of the co-accused.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S.
