The petitioner is languishing in custody since 03.07.2015 in connection with Desari (Chandpura O.P.) P.S. Case No. 245/2011 for the offences instituted under Sections 304(B) and 201/34 of the IPC.

The accusation is of killing the daughter of the informant for non-fulfilment of dowry demand by the accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.07.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. In paragraph nos. 20 and 21 of the

Patna High Court Cr.Misc. No.22313 of 2016 (4) dt.03-10-2016 2/2 case diary, it has been stated that the deceased died due to diarrhoea and vomiting. The Doctor of Primary Health Centre in paragraph no. 41 of the case diary has supported the aforesaid facts who had examined the deceased.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R. and he is the husband of the deceased.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Desari (Chandpura O.P.) P.S. Case No. 245/2011.
