The petitioner is languishing in custody since 29.06.2018 in a case registered for the offences punishable under Sections 25(1-B)a/26 of the Arms Act.

On 28.06.2018, on information received by the informant that some miscreants are planning to commit dacoity, a raid was laid by Sunil Kumar, Station House Officer of Narpatganj Police Station on 28.06.2018, when from the possession of the petitioner, two live cartridges were recovered. It is submitted by learned counsel for the petitioner that the investigation has already been concluded and the petitioner has falsely been roped in the present case, though, he is also accused in one another case lodged for the same incident under Section 399/402 of the Indian Penal Code.

Patna High Court Cr.Misc. No.5068 of 2019(2) dt.30-01-2019 2/2 Learned APP submits that from the possession of the petitioner two live cartridges were recovered. Considering the nature of recovery and the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 392 of 2018.
