Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.
No doubt, there is case and counter case between the parties and persons from both the sides sustained injuries but present occurrence took place in the year 2005 and petitioner could be remanded in this case on 03.04.2016 and the aforesaid fact goes to show that petitioner evaded his arrest for near about eleven years and held up the trial for a long period.
Patna High Court Cr.Misc. No.19193 of 2016 (2) dt.05-05-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Sessions Trial No. 148 of 2013 (CIS No. 34 of 2014) arising out of Gamhariya P.S. Case No. 18 of 2005 pending in the court of learned Assistant Sessions Judge-II, Madhepura stands rejected.
