The learned counsel for the petitioner submits that the petitioner has come before this Court against the order dated 09.09.2019 passed in Bail Petition no. 647 of 2019, whereby and wherunder the condition regarding deposit of Rs. 2,000/- per month in the account of the complainant-wife has been imposed upon the petitioner as a pre-condition for grant of bail. The learned counsel for the petitioner submits that Maintenance case is also going on, hence it be observed that in case, any maintenance is fixed, the petitioner would be at liberty to approach the learned Sessions Judge, Madhepura for
Patna High Court CR. MISC. No.3040 of 2020(2) dt.18-01-2020 2/2 modifying the order dated 09.09.2019.
Having regard to the limited submissions made by the learned counsel for the petitioner, I deem it fit and appropriate to dispose of the present petition as not pressed, however with liberty to the petitioner to approach the learned Sessions Judge, Madhepura for modifying the order dated 09.09.2019, in case any maintenance amount is fixed by the appropriate court, where it is stated that the maintenance case is pending adjudication.
With the aforesaid observations, the present petition stands disposed off as not pressed.
