The petitioner seeks bail in connection with Kawakole P.S. Case No. 92 of 2020 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 447, 448, 302, 307 & 504 of the Indian Penal Code.

As per the prosecution case, petitioner along with other co-accused persons have assaulted the informant's side with deadly weapons. It is further alleged that when the father and mother of the informant tried to save them, they were also assaulted and on raising alarm, they fled away. Thereafter, his mother and both brothers were taken to hospital for treatment, where they succumbed to injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 02-05-2023. Petitioner is stated to be man of clean antecedent.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is general and omnibus allegation against the petitioner. There is no specific allegation against the petitioner. Similarly siutated co-accused persons have been allowed bail by Co-ordinate Bench of this Court vide order dated 21-12-2020, 29-03-2022, 20-03-2023, 05-09-2023 & 22-02-2024, passed in Cr. Misc. No. 28997 of 2020, Cr. Misc. No. 56316 of 2021, Cr. Misc. No. 73467 of 2022, Cr. Misc. No. 55768 of 2023 & Cr. Misc. No. 11122 of 2024, respectively. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, clean antecedent of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court CR. MISC. No.13485 of 2024(2) dt.05-03-2024 3/3 two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Kawakole P.S. Case No. 92 of 2020.
