JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Bela P.S.Case No. 18 of 2010 registered under Sections 302/34 of the Indian Penal Code.

The accusation is that seven persons, named in the FIR, took away the son (Dinesh Kumar) of the informant but he did not returned and his dead body was found after one day. Submission of learned counsel appearing on behalf of petitioner is that it appears from FIR that only suspicion has been raised by the informant against the petitioner and other named accused persons. Further submission is that the petitioner has been made accused merely on the ground that her son was accompanied by this petitioner and others one day before recovery

Patna High Court Cr.Misc. No.17624 of 2016 (2) dt.28-04-2016 2/2 of his dead body. Further submission is that similarly situated coaccused, Rakesh Kumar, has already been allowed bail vide Cr. Misc. No. 10475 of 2013 on 12.04.2013.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.JM., Sitamarhi in connection with Bela P.S.Case No. 18 of 2010. Out of two sureties, one surety must be the close relative/parents of the petitioner.
