The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 323, 452, 354 and 447 of the Indian Penal Code.
Considering the nature of allegation against the petitioner to have committed house trespass after consuming wine in the house of the complainant and attempted to outrage her modesty, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Trial No. 4749 of 2018 arising out of Complaint Case No. 1666 of 2017 pending in the court of learned Chief Judicial Magistrate, Bettiah, West
Patna High Court Cr.Misc. No.4428 of 2019(2) dt.28-01-2019 2/2 Champaran.
However, prayer of the petitioner for regular bail shall be considered by the court below without being prejudiced of this order and on its own merit.
