JUSTICE SUDHIR SINGH ORAL ORDER 28-07-2015 The petitioner is languishing in custody since 15.03.2015 in connection with Khudwan P.S. Case No. 01 of 2015 for the offences instituted under Section 366(A)/34 of the IPC. Heard learned counsel for the petitioner and learned counsel for the State.
The accusation is of kidnapping the daughter of the informant by the petitioner and other accused persons. . It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.03.2015. It has further been submitted that the petitioner has been named in the F.I.R. merely on the basis of suspicion. There is no direct or indirect evidence against the petitioner. It has further been submitted that the petitioner may be released on bail after completion of six months
Patna High Court Cr.Misc. No.26124 of 2015 (2) dt.28-07-2015 2/2 in custody from 15.03.2015.
On behalf of the State it has been submitted that the victim in her statement recorded under Section 164 Cr. P.C. has named this petitioner.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of six months in custody i.e., from 15.03.2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Aurangabad, in connection with Khudwan P.S. Case No. 01 of 2015.
