The petitioner is accused in connection with Kahalgaon P.S. Case No. 35 of 2016, registered under Section 25(1-b)a, 26, 27 and 35 of the Indian Penal Code. The accusation is that in course of patrolling duty by the Police, three persons were seen fleeing away. On chase, one Sanjay Kumar Verma was apprehended by the Police and on search, one country made pistol was recovered, who disclosed the name of his two associates, namely, Shiwam Sah and Sanjit Tiwary (Petitioner).
Learned counsel for the petitioner submits that it would appear from the F.I.R. that the petitioner was not apprehended by the Police on the spot and petitioner having no
Patna High Court Cr.Misc. No.17732 of 2016 (2) dt.29-04-2016 2/2 criminal antecedent is in custody since 15.02.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon P.S.
