The petitioner seeks bail in connection with Sessions Trial No. 827 of 2024, arising out of Bath P.S. Case No. 86 of 2024 instituted for the offence under Sections 341, 323, 307, 504, 506 & 34 of the Indian Penal Code. 3.

Prosecution case in short is that petitioner has stabbed the younger son of the informant by means of knife, due to which he sustained injury.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.8217 of 2025(2) dt.18-02-2025 2/3 that the petitioner is in custody since 16-06-2024. Petitioner bears no criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Learned counsel for the petitioner submits that petitioner is alleged to have assaulted with knife on the neck and hand, but the injury report as discussed in the impugned order, suggests lacerated injury on neck and hand and hence the injury report of the injured, namely, Gaurav Kumar does not support the allegations as levelled against the petitioner. There is delay of eight days in lodging of the FIR. Charge sheet has been submitted in this case and charge is also framed. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge being framed, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sessions
