JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner is in custody since 13.3.2015 for the offence under Sections 399 and 402 of the I.P.C. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in short, is that on 12.3.2015 the informant, in course of patrolling duty, on receipt of secret information that 5-6 miscreants were drinking wine and planning to commit dacoity near culvert came there and caught four persons whereas two persons succeeded in fleeing away. Arrested four persons too disclosed the name of their associates. It is submitted on behalf of the petitioner that he is in custody since 13.3.2015. Charge sheet has already been submitted in this case. He has no criminal antecedent.The petitioner has been

Patna High Court Cr.Misc. No.26071 of 2015 (2) dt.24-07-2015 2/2 involved in this case due to mistake of fact. There is no recovery of any incriminating article from possession of the petitioner. It has been named on behalf of the State that the petitioner has been named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Kishanganj, in Dighalbank P.S. Case No. 29/15.
