JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are accused in connection with Nauhatta P.S.Case No. 66 of 2015 registered under Sections 307, 147, 148, 149 and 353 of the Indian Penal Code, Section 25(1b)a,26 and 35 of Arms Act, Sections 13, 15, 18 and 20 U.P.C.Act. The prosecution case is that on secret information about attacking on the police party by the miscreants, the police reached in the forest of Salha village where on seeing the police party 5-7 persons started to flee away. On chase all were apprehended and from their possession one country made pistol, one empty and ten live cartridges were recovered.

No.17643 of 2016 (2) dt.28-04-2016 2/2 Submission of learned counsel appearing on behalf of the petitioners is that the petitioners are in custody since 26.12.2015 and the petitioners have falsely been implicated in the present case. Further submission is that the petitioner no.2 has no criminal antecedent. Petitioner nos. 1, 3 and 4 are accused in Nauhatta P.S.Case No. 35 of 2015 in which they are on bail. Having considered the facts and circumstances of the case, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri, District- Rohtas in connection with Nauhatta P.S.Case No. 66 of 2015. Out of two sureties, one surety must be the close relative/ parents of the petitioners.
