JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. Counsel for the petitioner is directed to make necessary correction in paragraph 3 of the main application in the light of statement made in the supplementary affidavit in course of day.
The petitioner seeks bail in a case instituted for the offences under Sections 341, 323, 504, 385, 307, 34 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case in short is that while the informant was at home, the accused persons called and fired at him due to which he sustained injury.
It has been submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.3816 of 2019(8) dt.30-04-2019 2/2 the petitioner is in custody since 8.8.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Chargesheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. There is no substantive evidence to suggest his implication in the present case. The petitioner had no intention to cause injury to the victim. It is further submitted that the petitioner may be released after completion of one year in custody. On behalf of the State, it is submitted that the petitioner is named in the F.I.R. He is alleged to have fired in course of occurrence.
Considering the aforesaid facts and circumstances, on completion of one year in custody, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Parsa Bazar P.S. Case No. 19/2018.
