Petitioner is not named in the first information report nor does he has any criminal antecedent but in course of investigation, it came to light that son of the petitioner was arrested in Ahiyapur P.S. Case no. 285/2013 and made his confessional statement disclosing involvement of the petitioner in Ahiyapur P.S. Case no. 285/2013 as well as present case also and accordingly, petitioner has been made accused in this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar Singh, Judicial Magistrate, Ist Class, Muzaffarpur/concerned court in Saraiya P.S. Case no. 04/2013.
