Petitioners of both the above applications are accused in connection with Pachrukhi P.S. Case No.301 of 2015 registered under Sections 364(A)/34, 302, 201 and 120(B) of the Indian Penal Code. Therefore, the above applications are being heard together and disposed of by this common order. Learned counsel for the petitioners submits that the

Patna High Court Cr.Misc. No.18792 of 2016 (4) dt.29-06-2016 2/2 petitioners are not named in the F.I.R. In course of investigation, both the petitioners were apprehended by the Police and the Police got recorded the confessional statement of petitioner Prince Kumar on which basis a silver coloured Bolero vehicle was said to be recovered, which is said to be used in the kidnapping of deceased. Further submission is that similarly situated co-accused, Ajay Singh, Anil Kumar Singh and Sabita Devi have already been granted privilege of bail by this Court vide order dated 29.04.2016 passed in Criminal Misc. No. 9765 of 2016, Criminal Miscellaneous No. 11312 of 2016 and Criminal Miscellaneous No. 12579 of 2016, respectively. Further submission is that petitioners having no criminal antecedent are in custody since 27.11.2015 and 11.01.

Having considered the fats and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.- VII, Siwan in connection with Pachrukhi P.S. Case No. 301 of 2015.
