2. The present petition has been preferred for the following relief:

"for quashing the order dated 30th September, 2016 passed by the Bihar Land Tribunal (Shortly put as B.L.T.) in Patna in B.L.T. Case No. 742/2015 under which the learned Chairman of the B.L.T. (Bihar Land Tribunal) dismissed the application filed by the petitioner by holding the land is not agricultural rather

Patna High Court CWJC No.7623 of 2017(3) dt.16-04-2025 2/2 homestead, order by committing an error of record and law affirming the order passed in revision in view of the facts and circumstances stated hereunder."

3. Mr. Saurabh Kumar, learned counsel for the petitioner in the presence of learned State counsel submits that the petitioner is no more and as such, the petition now becomes infructuous, in that background, he may be permitted to withdraw the case.

5. The present writ petition stands dismissed as withdrawn.
