The petitioner seeks regular bail in connection with Sikandra P.S. Case No. 77 of 2018, registered for the offence punishable under Section 392/34 of the Indian Penal Code. The allegation is regarding unknown miscreants having committed loot in the Bank and had taken away a sum of Rs. 5,00,000/- approximately.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that neither any recovery has been made from the conscious possession of the petitioner nor any Test Identification Parade has been held so as to connect the petitioner with the alleged crime. It is further submitted that
Patna High Court Cr.Misc. No.4026 of 2019(2) dt.25-01-2019 2/2 barring one case, the petitioner is having a fair antecedent and in the said case, he is on bail. It is also submitted that similarly situated co-accused person has already been granted bail by this Court by an order dated 10.12.2018 passed in Criminal Miscellaneous No. 71562 of 2018. The petitioner is stated to be languishing in custody sine 04.07.2018. Having regard to the facts and circumstances of the case and also the fact that similarly situated co-accused person has been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Jamui in connection with Sikandra P.S.
