JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner, learned counsel for the complainant and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 406, 420, 341, 323, 379, 504/506 of the Indian Penal Code. As per prosecution case, it is a case of cheating and receiving the amount of total Rs. 8,05,500/- by the accused persons from the complainant.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner and the complainant were close friends but due to some monetary dispute, the petitioner has falsely been implicated in this case. The petitioner was ready to resolve the dispute which has been arose between them but in the

Patna High Court CR. MISC. No.6224 of 2023(4) dt.19-06-2023 2/2 meantime, the complainant filed a false case against him. It is further submitted that it is a case of civil in nature. It is further submitted that the petitioner is languishing in judicial custody since 21.10.2022.

Learned APP appearing for the state and learned counsel for the complainant have vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Ariyari P.S. Case No. 246 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Sheikhpura/concerned Court.
