Petitioner is not named in the first information report but in course of investigation, some witnesses expressed their suspicion against the petitioner.

Learned counsel for the petitioner submits that, as a matter of fact, father of the petitioner was murdered for which Charpokhari P.S. Case no. 38/2001 was lodged against Sunil Paswan and others. Subsequently, Sunil Paswan and some others were convicted and after that brother of the aforesaid Sunil Paswan dragged the petitioner in the present case.

No doubt, petitioner carries criminal antecedent of near about eight cases but explanation on behalf of the petitioner is that petitioner has been dragged in almost all cases due to rivalry and previous enmity.
