Petitioner seeks bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.

According to FIR, the petitioner and three others assaulted to Sri Kant Singh, the husband of the informant, with farsa, Gandasi and Tanguli (all sharp cutting weapons) as a result whereof Sri Kant Singh died.

The postmortem report would reveal that the Doctor has not found any cut injury or any visible injury on vital part of the body. The external injuries noticed by the Doctor were burn mark on left forearm, bruise on back of left side of shoulder, bruise on back of lumber region, lacerated wound on right wrist, lacerated wound on the left hand, lacerated wound on left leg

Patna High Court CR. MISC. No.4326 of 2019(3) dt.18-04-2019 2/2 and abrasion on right knee joint. The cause of death was head injury.

Learned counsel for the informant opposed the prayer for bail.

Considering the inconsistency in the ocular and medical evidence, let the petitioner, above named, who is in custody since 05.09.2018, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Paharpur Police Station Case No. 286 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
