JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414 of the Indian Penal Code.

Two persons, namely, Raju Kumar and Mukesh Kumar were arrested with stolen truck and the aforesaid persons disclosed that they had brought the aforesaid truck for sale at the direction of petitioner and except the aforesaid material as well as some criminal antecedent of the petitioner, there appears to be nothing against the petitioner. Moreover, co-accused, who were apprehended with stolen truck, have already been granted privilege of bail by a co-ordinate Bench of this court vide order

Patna High Court Cr.Misc. No.19045 of 2016 (2) dt.05-05-2016 2/2 dated 16.06.2015 passed in Cr. Misc. No. 18804 of 2015. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Saran at Chapra in connection with Sessions Trial No. 324 of 2015 arising out of Garkha P.S. Case No. 230 of 2014.
