JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457/380 of the Indian Penal Code.

Petitioner is not named in the first information report and the name of the petitioner surfaced in this case in confessional statement of co-accused Pappu Yadav, who has already been granted bail by a Co-ordinate Bench of this Court vide order dated 1.2.2019 passed in Cr. Misc. No. 3508 of 2019. It appears that except the aforesaid confessional statement of coaccused as well as some criminal antecedents of the petitioner, there is nothing against him. Petitioner is in custody since 24.11.2018.

No.4263 of 2019(3) dt.15-03-2019 2/2 Accordingly, it is ordered that the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria/concerned court in connection with Khagaria P.S. Case No. 752 of 2018.
