JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mahila P.S. Case No. 82 of 2018, registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. Vide order dated 26.3.2019 as both the parties appeared the matter was referred to the Patna High Court Conciliation and Mediation Centre and the Mediation Centre has submitted its report at Flag 'A', which disclosed that the dispute between the parties has been resolved through the process of mediation in terms of settlement reached between the parties.

Heard both sides.

Having heard both sides and considered the above fact, let petitioner, above named, surrender within a period of

No.4730 of 2019(5) dt.29-04-2019 2/2 six weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Smt. Priya Shekhar, Judicial Magistrate, 1st class, Patna, in connection with Mahila P.S.Case No. 82 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner will abide by the terms and conditions of mutual agreement between the parties, otherwise the opposite party No.2 is free to move before the court below itself. This application is, accordingly, disposed of. Let a copy of the report of the Mediator along with the memorandum of agreement be sent to the court below for needful.
