Petitioner apprehends arrest in connection with Excise Case No. 343 of 2021 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery has been made from a tempo which does not belong to this petitioner. Petitioner has no concern with the seized article.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.5657 of 2023(2) dt.29-04-2023 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, Court No. 1, Rohtas at Sasaram in connection with Excise Case No. 342 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
