JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-05-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 05.01.2016 passed in Cr. Misc. No. 43515 of 2015 on the ground that the petitioner has got now no criminal antecedent as in the earlier case he has already been acquitted. The alleged Tempo was not recovered from conscious possession of the petitioner nor from his house and he is suffering in custody since 08.06.2015, to which the learned A.P.P. opposes.
In the facts and circumstances as stated above, considering that on the basis of confessional statement of the petitioner the said Tempo was recovered and further considering
Patna High Court Cr.Misc. No.20251 of 2016 (2) dt.11-05-2016 2/2 that the driver of the said Tempo was strangulated to death, at present I am not inclined to reconsider the prayer for bail of the petitioner and accordingly his such prayer stands rejected in connection with Dhanarua P.S. Case No. 149 of 2015 pending in the court of the Judicial Magistrate, 1st Class, Masaurhi. However, let the trial be expedited and concluded preferably within a period of nine months from the date of receipt/production of a copy of this order.
