The petitioner is in custody in connection with Kotwali P.S. Case No. 736 of 2018 (Special case No. 10146/2018) registered for the offence punishable under Section 30 (a)/37 (b) (c) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case 39 liters Desi wine was recovered from the possession of the petitioner. Petitioner is in custody since 24.10.2018.

Considering the fact that petitioner has no criminal antecedent and he is in custody in this case since 24.10.2018, let the petitioner named above is directed to be released on bail on
