Patna High Court CR. MISC. No.7128 of 2020(3) dt.28-02-2020 2/3 with Sakra P.S. Case No. 286 of 2019 for the offence under Sections 147, 148, 149, 341, 323, 308, 337, 338 and 379 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is a counter case on account of the incident which took place on the same day. It is alleged that petitioners were involved in attacking at the shop of the informant and in the scuffle Mukesh, Premlal have assaulted the informant side.
Allegation against Mr. Ram Kumar, petitioner no. 7 is that he has given fist blow whereas allegation against Ram Narayan, petitioner no. 1 is that he was involved in pelting stones.
Considering the fact that the allegation of assault is specifically against Mukesh and Premlal, the Court is inclined to grant bail in the instant case where there is case and counter case and there is no specific act of the assault causing injury to the informant side, in the event of arrest or surrender before the court below within one week from today, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty five thousand) with two sureties of the like amount to the satisfaction of Sub Judge-XIII-cum-Additional Chief Judicial Magistrate-IV, Muzaffarpur in connection with Sakra P.S. Case No. 286 of
Patna High Court CR. MISC. No.7128 of 2020(3) dt.28-02-2020 3/3 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
