JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2019 This is an application for grant of anticipatory bail in connection with Khajauli P.S. Case No. 172 of 2012, disclosing offences under Sections 147, 148, 149, 341, 323, 333, 337, 427, 452, 435, 436, 380, 504, 506 and 120(B) of the Indian Penal Code and Section 3⁄4 of the Prevention of Damage to Public Property Act.

Allegation against the petitioners and several other accused persons is that they have entered into the office of Child Development Project Officer, Khajauli and damaging the documents and furnitures. Petitioners are not named in the F.I.R. It further appears that the petitioners are accused in several other

Patna High Court CR. MISC. No.5990 of 2019(3) dt.29-03-2019 2/2 cases.

Submission of learned counsel for the petitioners is that they have not named in the F.I.R. and their names transpired only during the supplementary investigation in the year 2017 and so far criminal antecedents are concerned, it has specifically mentioned in para-3 of the petition that all those case were lodged on 14.10.2012 and considering the same, this High Court has granted bail to the petitioners in most of the cases. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Madhubani, in connection with Khajauli P.S. Case No. 172 of 2012, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Amjad/- U T
