JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 The petitioner seeks regular bail in connection with Bidupur P.S. Case No. 121 of 2013, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation against the petitioner is of snatching a motorcycle and other articles. Petitioner is not named in the First Information Report but later on he has been made accused on the basis of confessional statement of co-accused and remanded in this case from other case. It further appears that he is accused in three other cases.

Submission of learned counsel for the petitioner is that except confession so far as this case is concerned there is nothing against the petitioner and he is in judicial custody since 18.02.2020.

Heard learned A.P.P. who has opposed the prayer for bail.

No.8689 of 2020(2) dt.28-02-2020 2/2 Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-XIV, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 121 of 2013. In view of the antecedents of the petitioner, the petitioner is directed to appear before the Superintendent of Police, Vaishali within fifteen days of his release with a copy of this order and every two weeks thereafter for the next six months. The conduct of the petitioner will be kept under watch in this period by the Superintendent of Police concerned and if it is found wanting in any respect, a report shall be made to the Court concerned by him to initiate a proceeding for cancellation of bail for reasons of misuse of bail. After reporting to the Superintendent of Police, a certificate will be filed by the petitioner before the Court concerned.
