Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 34 of the I.P.C and Section 27 of Arms Act.

There is general and omnibus allegation of commission of assault with Lathi to the deceased. Since the Doctor had found a case of respiratory failure, co-accused Vinay Mahto was allowed bail by a Coordinate Bench of this Court vide order at Annexure-2. Investigation of the case is already complete. Petitioner is in custody since 26.06.2020. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.15950 of 2021(2) dt.13-07-2021 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Belchhi Police Station Case No.39 of 2016 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
