JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-06-2015 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks bail in a case registered for the offence punishable under Sections 447, 341, 324, 307, 380, 504/34 of the Indian Penal Code.

The allegation against the petitioner is to have assaulted the informant with farsha on the head of the informant and further allegation against the accused including the petitioner is to have entered into the house of the informant and took away various articles including money from his house. It is submitted that the petitioner has also been assaulted by the informant and other. The petitioner has also received injury for which he has lodged Gopalganj P.S. Case No.

518 of 2014 for the offence punishable under Sections 307 and other allied sections of the Indian Penal Code and he was also hospitalized. It is further submitted that Harkesh Choudhary against whom there was allegation of assault with sword has been granted anticipatory bail vide Criminal Miscellaneous No. 14777 of 2015.

Learned counsel for the other side has submitted that the doctor has also found the injury on the head of the informant. The petitioner has also criminal antecedent.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/court concerned after framing of charge in Gopalganj Town P.S. Case No. 517 of 2014, with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court

concerned.
