JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,504 and 379 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. It is alleged that the informant purchased certain land at village Darwa when the petitioner was pressurizing the informant for transfer of the said land in his father's name but the informant sold the said land to one Dharmashila Devi, thereafter the petitioner started giving life threatening. It is further alleged that on the alleged date of occurrence, while the informant was coming from market the petitioner snatched ten thousand rupees cash and
Patna High Court Cr.Misc. No.17511 of 2016 (2) dt.26-04-2016 2/2 abused by calling the caste name.
It is submitted by the learned counsel for the petitioner that in the background of land dispute, the accusation has been levelled. It is further submitted that the informant retracted from the initial version and has filed a petition to that effect before the learned court below.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Kaimur at Bhabua, in connection with Bhabua SC/ST P.S. Case No.59 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
