Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 414, 272, 273/34 and Section 30(A) of the Bihar Prohibition and Excise Act, 2016. Liquor was not recovered from physical possession or house of the petitioner. Rather name of the petitioner surfaced in the statement of co-accused from whose possession liquor was recovered from a vehicle. Petitioner is in custody since 06.10.2020.

No.16119 of 2021(2) dt.24-07-2021 2/2 Though the petitioner has got criminal antecedent of similar nature, however, there is no direct material against the petitioner in this case and investigation of the case against the petitioner is already complete. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Suppi Police Station Case No. 268 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
